End User License Agreement — Live Preflight

This agreement is between you and Shohei Yamaguchi, an individual developer ("the developer"), covering the Illustrator panel Live Preflight, also sold under the Japanese name 常駐する入稿チェックパネル ("the software"). By installing or using the software you accept these terms.

This is a translation of the Japanese agreement. Both say the same thing.

1. License

On purchase you receive a perpetual, non-transferable license to use the software. It is not a subscription and does not stop at a renewal date.

One license covers one person. That person may install the software on the computers they personally use, such as a desktop and a laptop. It does not cover other people. If several people at an organization use the software, each of them needs a license.

2. Trial

Without a license, you can use every feature for 14 days, counting only the days you use the check. After 14 days, verdicts and counts remain free to use. "Select", the names of the matching items, and Auto-update require a license.

Circumventing these limits, for example by altering the stored trial record or modifying the software, is not permitted.

3. What you may not do

You may not resell, redistribute, or rent the software or your license key. You may not publish your license key or share it with others. A license key included with a BOOTH purchase is also for the buyer's own use only.

Because of the Adobe CEP format, the software is distributed as readable script files. You may look at them. You may not distribute modified copies, defeat the licensing mechanism, or incorporate the code into another product.

4. Updates

Bug fixes and minor updates to the version you purchased are provided at no cost. The developer does not commit to a release schedule, to support for future Illustrator versions, or to providing major new versions free of charge.

5. Refunds

This is a digital product, so as a rule purchases are not refunded. Please confirm that the software works for you with the trial before you buy.

However, if a defect on the developer's side makes the software unusable (for example, the full version does not work in a setup where the trial worked), contact the developer within 30 days of purchase. If the problem cannot be resolved, you will be refunded. Gumroad purchases are refunded through Gumroad. When you receive a refund, the license becomes invalid and you can no longer use the software as the full version.

Nothing in this agreement limits rights you have under applicable law.

6. No warranty

The software is provided as an aid for checking. It does not guarantee that it finds every problem in print data. Make the final decision by eye and with proofs. The software only reads your document. It does not modify your artwork and does not save or delete files.

The developer does not warrant that the software is free of defects, that it will run on every configuration, or that it will keep working with future versions of Illustrator.

7. Limitation of liability

To the extent permitted by applicable law, the developer's liability relating to the software is limited to the amount you paid for it.

The developer is not liable for indirect damages caused by the software's results or by what it misses, including reprinting costs, lost profits, and lost work. This does not apply where liability cannot be limited by law, such as in cases of the developer's intent or gross negligence.

8. Termination

This license ends if you breach these terms, in particular sections 2 and 3. On termination you must stop using the software and remove it from your computers.

9. Governing law

This agreement is governed by the laws of Japan.
